## 1. Introduction

Welcome to Rainbow Funding, a South African crowdfunding platform that connects project creators with potential backers. By accessing or using Rainbow Funding, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.

## 2. Definitions

– *”Platform”* refers to Rainbow Funding, including its website, mobile application, and all associated services.
– *”User”* refers to anyone who accesses or uses the Platform, including Project Creators and Backers.
– *”Project Creator”* refers to users who create and publish crowdfunding campaigns on the Platform.
– *”Backer”* refers to users who contribute funds to projects on the Platform.
– *”Campaign”* refers to a project or cause that is seeking funding through the Platform.

## 3. User Eligibility

– Users must be at least 18 years old and have the legal capacity to enter into a binding agreement.

## 4. Account Registration

– To use certain features of the Platform, you must create an account.
– You are responsible for maintaining the confidentiality of your account information and password.
– You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

## 5. Project Creation

– Project Creators must ensure that all information provided about their Campaign is accurate, honest, and not misleading.
– Rainbow Funding reserves the right to review, approve, or reject any Campaign at its discretion.
– Project Creators are solely responsible for fulfilling any promises or rewards offered to Backers.

## 6. Funding Process

– Backers may contribute to a Campaign by making payments through the Platform.
– All contributions are final and non-refundable unless the Project Creator fails to fulfill their obligations.
– Rainbow Funding does not guarantee that Campaigns will reach their funding goals or that Project Creators will fulfill their promises.

## 7. Fees and Payments

– Rainbow Funding charges a service fee on the total funds raised by a Campaign. The fee structure is detailed on the Platform.
– Payment processing fees may also apply, which will be deducted from the funds raised.
– Project Creators will receive funds after the Campaign ends and all fees have been deducted.

## 8. User Conduct

– Users agree to use the Platform in compliance with all applicable laws and regulations.
– Users must not engage in any activity that is fraudulent, harmful, or otherwise objectionable.
– Rainbow Funding reserves the right to suspend or terminate any account that violates these Terms and Conditions.

## 9. Intellectual Property

– All content on the Platform, including text, graphics, logos, and software, is the property of Rainbow Funding or its licensors and is protected by South African and international copyright laws.
– Users may not use, reproduce, or distribute any content from the Platform without prior written permission from Rainbow Funding.

## 10. Limitation of Liability

– Rainbow Funding provides the Platform “as is” and makes no representations or warranties of any kind, express or implied, regarding the Platform or its content.
– Rainbow Funding will not be liable for any damages arising out of or in connection with the use of the Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

## 11. Indemnification

– Users agree to indemnify and hold harmless Rainbow Funding, its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, or expenses arising out of or related to the user’s use of the Platform or violation of these Terms and Conditions.

## 12. Privacy

– Rainbow Funding respects your privacy and will handle your personal information in accordance with its Privacy Policy, which is available on the Platform.

## 13. Governing Law

– These Terms and Conditions are governed by the laws of the Republic of South Africa.
– Any disputes arising from or related to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of South Africa.

## 14. Amendments

– Rainbow Funding reserves the right to amend these Terms and Conditions at any time.
– Any changes will be effective immediately upon posting on the Platform, and your continued use of the Platform will constitute acceptance of the revised Terms and Conditions.

 ## 16. FICA Requirements

Transactions greater than or equal to R20 000(twenty thousand rand) needs to be verified in accordance with FICA regulations and thus we will request:

– Proof of residential address

– Copy of Identity document or passport

– Confirmation that the donation was made by you and also that we may proceed to allocate it to the specific campaign it was intended for.

## 17. Right to decline

If in any circumstances the campaign is offensive to any person or seems inappropriate in any way, or if the funds raised doesn’t seem to be used 

for the initially intended purposes, RainbowFunding reserves the right to decline the campaign.
